Terms & Conditions

In these Terms and Conditions:

• “Company”, “we”, “us”, “our” refers to Smartinfo Care Solutions Pvt. Ltd., the owner and operator of FollowUpEasy.
• “Platform” refers to the FollowUpEasy web application available at followupeasy.in and any associated mobile apps or tools.
• “User”, “you”, “your” refers to any individual or business entity that registers for or uses FollowUpEasy.
• “Subscription” refers to your paid or free plan for accessing the Platform.
• “Lead Data” refers to the contact information, messages, notes, and other data about your customers or prospects that you store in the Platform.
• “WhatsApp Integration” refers to the connection between your WhatsApp Business account and the Platform via the Meta WhatsApp Business API.

To use FollowUpEasy, you must:

• Be at least 18 years of age
• Be a registered business entity or a sole proprietor operating a legitimate business in India
• Have the legal authority to bind your business to these Terms if registering on behalf of an organisation
• Have a valid WhatsApp Business account and a verified Facebook Business Manager account (required for WhatsApp integration)

We reserve the right to refuse access to any user or business at our sole discretion.

When you register on FollowUpEasy, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised use of your account at support@followupeasy.in
• Accept responsibility for all activities that occur under your account

You may not share your account credentials with third parties or create accounts on behalf of others without their consent.

By using the WhatsApp integration, you agree that:

• You are solely responsible for obtaining any necessary consents from your contacts before messaging them via WhatsApp
• You will only send messages that comply with Meta’s WhatsApp Business Policy
• You will not use FollowUpEasy to send spam, unsolicited messages, or messages that violate Meta’s messaging guidelines
• You are responsible for the content of all messages sent through your connected WhatsApp Business number
• Meta may charge separately for WhatsApp Business API messages as per their current pricing
• FollowUpEasy is not affiliated with, endorsed by, or officially partnered with Meta Platforms, Inc.

5.1 Plans

FollowUpEasy offers Free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at the time of purchase.

5.2 Payment

Payments are processed securely through Razorpay. By subscribing, you authorise us to charge your selected payment method for the applicable subscription fees. All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

5.3 Renewal

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You will receive a reminder email before renewal. We reserve the right to change subscription pricing with at least 30 days’ advance notice.

5.4 Refund Policy

To request a refund, email support@followupeasy.in with your registered email and transaction ID.

5.5 Free Plan Limitations

The Free plan is subject to usage limits as specified on our pricing page. We reserve the right to modify free plan limits at any time with reasonable notice.

You agree to use FollowUpEasy only for lawful business purposes. You must not use the Platform to:

• Send spam, bulk unsolicited messages, or engage in phishing or fraud
• Harass, abuse, or threaten any individual
• Collect or store personal data of minors
• Violate any applicable Indian law including the Information Technology Act, 2000
• Attempt to gain unauthorised access to our systems or other users’ accounts
• Reverse engineer, decompile, or copy any part of the Platform
• Resell or sublicense access to FollowUpEasy without our written permission
• Use the Platform in a way that disrupts, damages, or impairs its availability to other users
• Store or transmit any content that is defamatory, obscene, or illegal

Violation of these terms may result in immediate suspension or termination of your account without a refund.

Your data belongs to you. All Lead Data, customer contact information, and business data you upload or generate within FollowUpEasy remains your property. We do not claim ownership of your data.

By using the Platform, you grant Smartinfo Care Solutions Pvt. Ltd. a limited, non-exclusive licence to store, process, and use your data solely for the purpose of providing and improving the Platform’s services to you.

We handle your data in accordance with our Privacy Policy, which forms part of these Terms.

All content, features, design, code, trademarks, and technology that make up the FollowUpEasy platform are the exclusive property of Smartinfo Care Solutions Pvt. Ltd. or its licensors. You are granted a limited, non-transferable, non-exclusive licence to use the Platform as long as your subscription is active.

You may not copy, reproduce, modify, distribute, or create derivative works from any part of our Platform without prior written permission.

We aim to provide a reliable service and target 99.5% uptime, excluding scheduled maintenance. However:

• We do not guarantee uninterrupted or error-free access to the Platform
• Scheduled maintenance will be communicated in advance where possible
• We are not responsible for service interruptions caused by third-party providers (Meta, AWS, Razorpay, etc.) or factors outside our control
• In the event of significant unplanned downtime, we will communicate updates via email and our status page

To the fullest extent permitted by applicable law:

• FollowUpEasy is provided “as is” and “as available” without warranties of any kind, express or implied
• Smartinfo Care Solutions Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunities
• Our total liability to you for any claim arising out of these Terms shall not exceed the total amount paid by you to us in the 3 months preceding the claim
• We are not responsible for losses arising from your non-compliance with Meta’s WhatsApp Business policies or suspension of your WhatsApp Business account

You agree to indemnify and hold harmless Smartinfo Care Solutions Pvt. Ltd., its directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform in violation of these Terms
• Your violation of any third-party rights, including privacy or intellectual property rights
• Your non-compliance with Meta’s WhatsApp Business API policies
• Any false, misleading, or inaccurate information you provide on the Platform

12.1 Termination by You

You may cancel your subscription and delete your account at any time through the Platform settings or by contacting support@followupeasy.in. Upon cancellation, your access will continue until the end of the current billing period.

12.2 Termination by Us

We reserve the right to suspend or terminate your account immediately and without prior notice if:

• You violate any provision of these Terms
• We receive a valid legal order requiring termination
• You engage in fraudulent, abusive, or illegal activity on the Platform
• Your account remains inactive for more than 12 consecutive months on a Free plan

12.3 Effect of Termination

Upon termination, your access to the Platform will cease. We will retain your data for 30 days post-termination, during which you may request an export. After 30 days, your data will be permanently deleted (except billing records retained for legal compliance).

We reserve the right to modify, update, or discontinue any feature of FollowUpEasy at any time. For significant changes that affect your use of paid features, we will provide at least 30 days’ advance notice. Continued use of the Platform after changes take effect constitutes acceptance.

If you have a dispute with us, we encourage you to first contact us at support@followupeasy.in so we can try to resolve it informally.

If a resolution cannot be reached within 30 days, any dispute arising out of or in connection with these Terms shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996 of India, with the seat of arbitration in Mohali, Punjab.

These Terms are governed by and construed in accordance with the laws of India. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of courts located in Mohali, Punjab, India.

We may update these Terms from time to time. When we make material changes, we will notify you via email and/or an in-app notice at least 7 days before the changes take effect. Your continued use of FollowUpEasy after that date constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smartinfo Care Solutions Pvt. Ltd. regarding your use of FollowUpEasy and supersede any prior agreements or understandings.
